Welcome to MenuLink ("we," "our," or "us"). These Terms and Conditions ("Terms") govern your use of the MenuLink website, platform, and services (collectively, the "Services"). By using our Services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use our Services.

These Terms constitute a legally binding agreement between you and MenuLink. Please read them carefully before creating an account or using our Services.

2. Definitions

• "Platform" refers to the MenuLink website, dashboard, and all associated services.
• "User" refers to any individual or entity that uses our Services.
• "Restaurant Owner" refers to a User who creates a restaurant account on the Platform.
• "Customer" refers to any individual who views a digital menu created through our Platform.
• "Content" refers to all information, data, text, images, and materials uploaded or displayed on the Platform.
• "Subscription" refers to the paid service plans offered by MenuLink.

3. Account Registration

To use our Services, you must create an account. By registering, you agree to:

• • Maintain and update your account information to keep it accurate.
• • Keep your login credentials confidential and secure.
• • Notify us immediately of any unauthorized use of your account.
• • Be responsible for all activities that occur under your account.

You must be at least 18 years old to create an account. By creating an account, you represent and warrant that you are 18 or older and have the legal capacity to enter into these Terms.

4. Services and Features

MenuLink provides a platform for restaurants to create and manage digital QR menus. Our Services include:

• • Digital menu creation and management
• • QR code generation
• • Restaurant dashboard and analytics
• • Menu item management (add, edit, delete)
• • Special offers and combo creation
• • Branding and customization options

We reserve the right to modify, suspend, or discontinue any part of our Services at any time with or without notice. We will not be liable for any changes to our Services.

5. User Content

You retain all ownership rights to the Content you upload to our Platform. By uploading Content, you grant MenuLink a non-exclusive, worldwide, royalty-free license to:

• • Store and display your Content on our Platform.
• • Use your Content to operate and improve our Services.
• • Share your Content with customers who view your digital menu.

You represent and warrant that:

• • You own or have the necessary rights to upload your Content.
• • Your Content does not violate any third-party rights.
• • Your Content is accurate and not misleading.

6. Prohibited Content and Activities

You may not use our Platform to upload or distribute Content that:

• • Is illegal, fraudulent, or deceptive.
• • Infringes on intellectual property rights.
• • Contains viruses, malware, or harmful code.
• • Is defamatory, abusive, or harassing.
• • Violates applicable laws or regulations.
• • Contains offensive or discriminatory content.

We reserve the right to remove any Content that violates these Terms at our sole discretion.

7. Subscriptions and Payments

MenuLink offers subscription plans with different features and pricing. By subscribing to any plan, you agree to:

Subscription Terms:

• • No refunds are provided for partial subscription periods.
• • We reserve the right to change pricing with 30 days' notice.
• • You are responsible for all taxes applicable to your subscription.

8. Free Trial

MenuLink offers a 14-day free trial for new users. During the trial period:

• • You have full access to all features of the Pro plan.
• • No payment information is required to start the trial.
• • At the end of the trial, you must subscribe to continue using the Service.
• • We reserve the right to modify or terminate the free trial offer at any time.
• • Only one free trial is available per restaurant.

9. Intellectual Property

All intellectual property rights in the MenuLink Platform, including but not limited to:

• • Software, code, and algorithms
• • Design, layout, and user interface
• • Graphics, logos, and branding
• • Documentation and content
• • Trademarks and service marks

are owned by MenuLink and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of our Platform without our prior written consent.

10. Data Privacy

Your privacy is important to us. Our collection and use of your personal information is governed by our Privacy Policy. By using our Services, you consent to the collection and use of your data as described in the Privacy Policy.

We implement reasonable security measures to protect your data. However, no method of transmission over the internet is 100% secure, and we cannot guarantee absolute security.

11. Third-Party Services

Our Platform may integrate with third-party services (e.g., payment processors, analytics providers). We are not responsible for the practices, privacy policies, or content of third-party services. Your use of third-party services is at your own risk and subject to their terms.

12. Limitation of Liability

To the maximum extent permitted by law, MenuLink and its affiliates, officers, employees, and agents shall not be liable for:

14. Indemnification

You agree to indemnify, defend, and hold harmless MenuLink, its affiliates, officers, employees, and agents from and against any claims, damages, losses, liabilities, costs, or expenses (including legal fees) arising out of or relating to:

15. Termination

We may terminate or suspend your account and access to our Services at any time, with or without cause, and with or without notice. You may terminate your account at any time by following the instructions in your dashboard or by contacting us.

Upon termination:

• • Your access to the Platform will be immediately revoked.
• • We may delete your Content and data within 30 days.
• • You will not be entitled to any refund for unused subscription fees.
• • Sections that by their nature should survive termination will survive.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or relating to these Terms or your use of our Services shall be subject to the exclusive jurisdiction of the courts in India.

17. Dispute Resolution
